Terms and Regulations for the promotional initiative Signorvino Club

Preamble

CALZEDONIA SPA, company subject to management and coordination by Calzedonia Holding SpA with head office located in Malcesine (VR), Via Portici Umberto Primo 5/3 and administrative headquarters located in Dossobuono di Villafranca (VR), Via Monte Baldo 20, VAT number 02253210237, hereby provides customers the chance to receive discounts, benefits and services at any “Signorvino” store (whether direct customers or members enrolled to the initiative) or through the website www.signorvino.com/it/en/.
To take advantage of these benefits, you must enrolled to the “Signorvino Card”: the issue of the “Signorvino Card” and its use are regulated by the following conditions (hereinafter, “Regulations”), which the “Intended Customer” must read carefully. Activating the “Signorvino Card” according to section 6, implies the acceptance on the part of the Customer of these Regulations.
Calzedonia SpA reserves the right to periodically change these conditions, even partially and the respective changes shall become effective after 10 (ten) days following their publication on the website www.signorvino.com/it/en/
In the event that the “Intended Customer” does not accept the implemented changes, the latter shall have the right to cancel its enrolment and said right can be exercised at any time, following the procedures specified hereafter.
Using the Card after the changes take effect implies in any case acceptance of the implemented changes by tacit consent.
Calzedonia Spa also reserves the right to temporarily or permanently suspend this loyalty programme at any time without having for the Customer to raise any claims (except for the compliance of the rights already acquired by the participants at that time), thereby sending a notice through the website www.signorvino.com/it/en/ or through the stores participating to the initiative.

1. Promoter

CALZEDONIA SPA, company subject to management and coordination by Calzedonia Holding SpA, with registered office located in Malcesine (VR), Via Portici Umberto Primo 5/3, VAT number 02253210237.

2. Channels of participation

  • All stores with the brand “Signorvino” whether they are managed directly by Calzedonia SpA (so-called “direct stores”) or affiliates, namely those managed by other companies (so-called “affiliated stores”) that participate to the initiatives displaying the respective advertising and informative materials. The list of stores participating to the initiative can be viewed at the website www.signorvino.com/it/en/

  • E-commerce website www.signorvino.com/it/en/

This promotional initiative consists of a loyalty programme that is based on a point gathering system with a digital card “Signorvino Card” and provides exclusive benefits to the card holders. The purpose of the initiative is to win the loyalty of Customers through a loyalty programme that provides benefits to holders with the “Signorvino Card” >Notwithstanding the provisions of the preamble, of section 7 (“Operating terms”) and of section 10 (“Discontinuing the programme - Deactivating the Card - Miscellaneous”), the “Signorvino Card” does not expire.

5. Recipients

End customers of legal age with the “Signorvino Card” according to the enrolment terms and conditions outlined hereafter.

6. Enrolment conditions

The card to acquire the “Wine Lover Status” can be issued directly by the store to the Customer in digital format through the website www.signorvino.com/it/loyalty or by contacting the customer care number at +39 0454520019 (toll number). The call is equivalent to a national call and the rate depends on the telephone provider. The enrolment to the loyalty programme Signorvino Club will require the creation of one specific account that can allow the Customer to access their personal page on the e-commerce website of the brand. The registration systems will not allow minors to enrol to the loyalty circuit. The activation/registration process takes place in compliance with privacy regulations. The Signorvino Card is personal and cannot be transferred. Customers may not activate more than one card during the validity period of the card. The Signorvino Card is for private use only and not for commercial use. The Customer may freely request to be cancelled from the loyalty programme at any time by contacting the customer care number at +390454520019 (toll number). The call is equivalent to a national call and the rate depends on the telephone provider. Alternatively, the Customer may cancel the programme through the website www.signorvino.com/it/en/loyalty/.

7. Operating terms

The “Signorvino Card” will allow Customers to reach 2 different STATUS by accumulating points on purchases. Depending on their status reached, Customers will receive increasing gratification.

“Wine Lover Status”:

  • This is acquired immediately with the activation/registration of the “blank” card;
  • When Customers with a “Wine Lover Status” reach 200 points they go to the next level - “Wine Expert Level” - where any excess points with respect to those used to reach the new status are credited immediately;
  • If the “Wine Lover Status” Customer does not reach 200 points within 365 days after the enrolment date, the “Wine Lover Status” shall remain and the balance will be reset.

“Wine Expert Status”:

  • The Customer reaches this status once 200 points are reached after getting the “Wine Lover Status”. When passing from one status to another status, any excess points with respect to those used to pass the level will be credited immediately;
  • A year after obtaining the “Wine Expert Status” and so forth year after year, Customers:
    • that reach at least 200 points, maintain the “Wine Expert Status” level and any excess points with respect to those used to preserve said status will be kept;
    • that do not reach 200 points, will have their balance reset and will go back to “Wine Lover Status” level.

Each change of status, as well as any notice regarding the participation to the loyalty programme and strictly indispensable for the provision of the services related thereto (such as by way of example, confirmation of enrolment/cancellation, change in status, allocation of dedicated discounts or reserved freebies) must be considered as required to run the programme. Therefore, by accepting these Regulations, the Customer agrees to receive said notices which will be forwarded to the addresses specified in the enrolment form of the programme. Refusal to receive said notices will result in the inability for Calzedonia Spa to proceed with the programme and provide the services related thereto. A refusal expressed during the programme will result in the automatic interruption of the programme.

8. Acquiring points

The loyalty points will be automatically added to the active “Signorvino Card” after each purchase at any “Signorvino” stores participating to the initiative (whether for restaurant/bar or for the purchase of wines, with the sole exception of the restaurant area at Hotel Veronesi la Torre) or purchases through the e-commerce website www.signorvino.com/it/en/, to the extent of one point for each euro spent rounded down (e.g. Euro 1,99 = 1 point).
Points credited from purchases made through the e-commerce website will be possible only after logging in to the respective Signorvino Club account. The card must be paired to the account only once and will be saved by the system for subsequent purchases.
In order to be entitled to receive points, Customers must identify themselves before getting a receipt upon showing their “Signorvino Card” or indicating their surname and name or email address that was given to activate the card. For purchases made through the e-commerce website, Customers must access the website using their respective credentials. If the card holders fail to identify themselves according to the above methods, points will not be added and will not be able to be added later. Customers may at any time learn about the number of points accumulated at any “Signorvino” store participating to the initiative or by consulting the website www.signorvino.com/it/en/
Points will be added and counted by the system on a daily basis. In case of unexpected technical issues, points may be added within a longer time of up to 15 days. Points will be deducted for product returns using the same criteria that was used to add them.
Points will be generated when a “Signorvino Gift Card” is purchased. Subsequent purchases paid partially or in full with Gift Cards pertaining to the same card holder will therefore not generate any points for the value of the receipt paid using said Gift Cards. There may be campaigns for double or triple points and appropriate advertising will be made. The Card does not imply in any way a pay card and the points accumulated cannot be transferred or converted into cash or into products.

9. Advantages

Customers holders of the “Signorvino Card” may benefit from numerous discounts, promotional activities, prize activities and special dedicated initiatives that will be duly advertised and notified each time. Customers may benefit from the dedicated advantages only after showing their “Wine Lover” Card or after accessing the dedicated area at www.signorvino.com/it/en/. In particular, the following discounts are hereby defined:

For all Status

  • WELCOME COUPON: Upon enrolment: 10% discount coupon that can be used within 30 days after issue in a single transaction through the e-commerce website or in Signorvino stores (both at the restaurant/bar area or wine purchasing area, with the sole exception of the restaurant area at Hotel Veronesi la Torre). It cannot be used for items with "Platinum" labels or for products already discounted or with other promotions.

  • LOYALTY WINE FEST: For the entire time during the Wine Lover or Wine Expert Status:
    • 10% discount for all purchases of wine to take away bought in store or from the e-commerce website www.signorvino.com/it/en/, with a minimum purchase of 6 bottles and except for items already discounted or with other promotions or items with the “Platinum” label.

    • 20% discount for all purchases of wine to take away bought in store or from the e-commerce website www.signorvino.com/it/en/, with a minimum purchase of 18 bottles and except for items already discounted or with other promotions or items with the “Platinum” label.

  • BIRTHDAY COUPON:
    • On their birthday, WINE LOVER Customers will be entitled to: 1 coupon for a complimentary cured meats, cheese or vegetarian selection, with a choice from Tagliere “Proibita & Pinsa”, Tagliere “Crudo & Pinsa”, Tagliere “Vegetariano” and Tagliere “Formaggi”. The coupon can be used within 30 days of the recipient’s birthday at Signorvino restaurants (excluding the Signorvino restaurant in Hotel Veronesi la Torre). Customers will also receive a coupon for free shipping on an online purchase from www.signorvino.com/it/en/, valid for 30 days from the recipient’s birthday.

    • On the birthday of each Wine Expert Customer and only during 7 days before and 23 days after the birthday: a Euro 20 coupon that can be used in a single transaction and with a minimum expense of Euro 60 in stores (both in the restaurant/bar area or wine purchasing area, with the exception of the catering area at the Hotel Veronesi la Torre) or through the e-commerce website www.signorvino.com/it/en/. It cannot be used for items with "Platinum" labels or for products already discounted or with other promotions.

  • 100 POINT COUPON:
    • Every 100 points, WINE LOVER Customers will be entitled to a 15% discount coupon with a validity of 30 days after its issue that can be used in a single transaction in stores (both in the restaurant/bar or wine purchasing area, with the sole exception of the restaurant area at Hotel Veronesi la Torre) or through the-commerce website www.signorvino.com/it/en/, except for items already discounted or with other promotions and items with the “Platinum” label.

    • • Every 100 points, WINE EXPERT Customers will be entitled to a 20% discount coupon with a validity of 30 days after its issue that can be used in a single transaction in stores (both in the restaurant/bar or wine purchasing area, with the sole exception of the restaurant area at Hotel Veronesi la Torre) or through the-commerce website www.signorvino.com/it/en/, except for items already discounted or with other promotions and items with the “Platinum” label.

    Customers (both Wine Lover or Wine Expert) may receive a maximum of 10 coupons for each purchase. For example: For an expenditure of Euro 1,200 in a single transaction, customers will receive 10 coupons “100 points”.

    10. Discontinuing the programme – Deactivating the Card - Miscellaneous

    Calzedonia Spa has the right to change, suspend or interrupt the loyalty programme “Signorvino Club” and the respective services at any time at its own discretion. A special notice will be given of said changes, suspensions or interruptions through a special notification on the website www.signorvino.com or at the stores participating to the initiative. Notwithstanding any other right set out by law, including the right to compensation for damages, Calzedonia Spa may revoke the right of the Customer to use the Card and deactivate the Card if the Card is used in breach of the conditions of these Regulations or in the event of abusive or damaging use of the image of the “Signorvino” trademark. Moreover, with prior notification, Calzedonia Spa reserves the right to deactivate the “Signorvino Card” and the respective activation/enrolment in case of non-use of the Card or inactivity of the Customer for a period of more than 5 years. In case of cancellation or deactivation, the Customer may not take advantage of the benefits and services of the “Signorvino Club”. Calzedonia Spa shall not be held liable for any inconveniences caused directly or indirectly, regarding malfunctions of the loyalty programme that are beyond its control. Calzedonia Spa will not be liable for any fraudulent, improper or abusive use of the Card.

    11. Information statement on the processing of personal data

    This statement describes the procedures on how personal data will be processed for members enrolled to the “Signorvino Club” loyalty programme.

    Who is the Data Controller?

    The Data Controller is Calzedonia S.p.A. with head office located in Via Portici Umberto Primo 5/3, Malcesine (Verona, Italy) and administrative headquarters located in Via Monte Baldo 20, Dossobuono di Villafranca (Verona, Italy).     Why do we use the data of members enrolled to loyalty programme?

    Below a list of the purposes for which we gather personal data for the loyalty programme.

    Managing the loyalty programme Signorvino Club
    Purpose: manage the participation to the loyalty programme “Signorvino Club”. The data will be used to provide discounts and advantages reserved for members enrolled to programme and in general to meet all contractual and related administrative obligations.
    Data processed: personal and contact data (name, surname, mailing address, email address, telephone number) provided on the online registration form or if the registration is made through Signorvino stores, requested by sales assistants; data regarding purchases made and regarding points, coupons and discounts provided.
    Legal basis: conclude the enrolment contract for the loyalty programme (Regulations for the loyalty programme Signorvino Club).
    Preservation period: the time required to manage the participation to the loyalty programme. In any case, information regarding purchases and interactions with us will be kept for no more than 12 months, effective as of the collection date.
    Entities to whom the data is disclosed: in addition to the entities outlined in the paragraph "To whom do we disclose the data?", for this specific purpose we need to disclose the data of members enrolled to the loyalty programme, to employees of Italian companies that, based on a business affiliation contract, manage the stores with the brand “Signorvino”.

    Customised assisted sales
    Purpose: to provide customised assisted sales dedicated to members enrolled to the loyalty programme that can rely on the help and consultancy of our sales assistants.
    Data processed: information (e.g. size, colour, model) regarding purchases made in the 12 previous months.
    Legal basis:> legitimate interest to provide the best assistance service in the stores to customers enrolled to the loyalty programme, in line with their needs.
    Preservation period: 12 months effective as of the collection date.
    Entities to whom the data is disclosed: : in addition to the entities outlined in the paragraph "To whom do we disclose the data?", for this specific purpose we need to disclose the data of members enrolled to the loyalty programme, to employees of Italian companies that, based on a business affiliation contract, manage the stores with the brand “Signorvino”.

    Statistical analysis
    Purpose: to create statistical reports and behavioural models to examine, in aggregate form, the efficiency of the commercial initiatives (e.g. the launch of a new product) of Calzedonia SpA from an economic standpoint and address future commercial and promotional initiatives.
    Data processed: information regarding purchases (even in relation to other brands of the Calzedonia Group), countries of origin, age, gender, information obtained by examining the interaction of members enrolled to the loyalty programme with us, through emails, our websites and through the Apps that may be developed by us or by third parties (for more information, consult the respective privacy information statements).
    Legal basis: the legitimate interest of Calzedonia SpA to analyse, in pseudonymised form (hence without information directly attributed to each customer), the data of customers to obtain strategic information regarding the buying behaviour of customers, the methods with which customers interact with the companies through the various communication channels and the efficiency of the commercial and promotional initiatives, with the purpose of competing with major operators of the sector.
    Preservation period: the data regarding the purchases will be kept, in pseudonymised form, for a period of five years. The other personal data will be kept, in pseudonymised form, for a period of two years.

    Sending commercial information (“Direct Marketing”)
    Purpose: sending commercial information through the traditional mailing service, by email, by text messaging, by landline phone or by mobile phone, conducting market research and surveying activities to understand the level of satisfaction of our customers regarding products for all the brands of the Calzedonia Group (Calzedonia, Intimissimi, Atelier Emé, Tezenis, Falconeri and Signorvino). Enrolling to the loyalty programme “Signorvino Club” is not in any way subject to an issue of a consent to receive our sales and marketing materials. Legal basis: consent by members enrolled to the loyalty programme that can be cancelled at any time by writing an email to privacy@calzedonia.com or by accessing the reserved area.
    Preservation period: until the consent is cancelled by the member enrolled to the loyalty programme.

    Profiling
    Purpose: profiling allows us to send sales and marketing materials customised based on the profile and purchasing and browsing habits of our customers, in addition to developing products and services in line with our customers' preferences. In any case, said profiling activities are aimed at better customising our services and do not entail any legal or major effects to the enrolled member. Enrolling to the loyalty programme “Signorvino Club” is not in any way subject to an issue of a consent to profiling.
    Data processed: data regarding purchases, even of other brands of the Calzedonia Group (Calzedonia, Intimissimi, Atelier Emé, Tezenis, Falconeri and Signorvino), regarding the country of origin, gender and age, the interaction with us through our website, through the Apps that may be developed by us or by third parties and through our social channels (e.g. Facebook). Moreover, we could examine data regarding the possible participation to the loyalty programme “Signorvino Club” and regarding the use of the services provided by us. Lastly, we may enhance the profile of members enrolled to the loyalty programme with statistical information that can be gathered by us lawfully from other sources: for example, in relation to their place of residence (like for example, demographic information, geo-referenced data, etc.) or related to the electronic instruments that they use to interact with us.
    Legal basis : consent by members enrolled to the loyalty programme that can be cancelled at any time by writing an email to privacy@calzedonia.com or by accessing the reserved area.
    Preservation period: data regarding interactions with us will be preserved for 12 months, effective from the collection data. Whereas, information regarding purchases will be kept for 3 years, effective as of the time in which each purchase is made.

    To whom do we disclose the data?

    In order to reach the above purposes, we need to disclose the data of enrolled members to the following category of entities:

    • Employees of Calzedonia S.p.A in charge of managing our Loyalty Programme;

    • Suppliers of Calzedonia S.p.A (e.g. providers of services and IT platforms), acting as “Data Processors”, appointed by Calzedonia S.p.A, by signing specific contracts.

    Do we transfer the personal data of members enrolled to the loyalty programme to countries outside the EU?

    The personal data gathered may be transferred outside the European Union. In this case, the transfer will take place in compliance with the provisions of the General Data Protection Regulation EU 2016/679 (“GDPR”) (in particular, data will be transferred only after signing the respective Standard Contractual Clauses approved by the EU Commission with decision no. 2021/914/EU or transferred to countries that can guarantee a proper protection level of the personal data and therefore recipients that have an adequacy decision adopted by the EU Commission).

    Has a Data Protection Officer (“DPO”) being appointed?

    Calzedonia S.p.A. has appointed a Data Protection Officer to supervise the observance of personal data protection regulations and to act as a point of contact for requests of Data Subjects and may be contacted at the following email address dpo@calzedonia.com

    What are the rights of Data Subjects?

    Members enrolled to the Loyalty Programme “Signorvino Club”, in their capacity of Data Subjects may exercise the rights that the GDPR guarantees them in regards to their personal data by writing an email to privacy@calzedonia.com. We undertake to respond to requests in the shortest possible time and in any case by no later than thirty days after receipt of the request. In some cases, we ask for a copy of an identification document if for a specific request, the identity of the requesting party must be identified. In particular, Data Subjects may exercise the following rights:

    • Right to access the data, namely the right to know if their personal data is being processed and if confirmed, the right to obtain a copy of said data and be informed about: the origin of the data, the category of personal data being processed, the recipients of the data, the processing purposes, the existence of an automated decisional process (including profiling), the preservation period of the data and the rights envisaged by the GDPR;

    • The right to request to rectify or supplement the data;

    • Right to erasure of personal data whenever said data is no longer required for the purposes for which they were gathered or whenever they are no longer authorised to process them

    • Right to limit the processing of personal data in the following cases: i) the Data Subject disputes the accuracy of the personal data. The restriction of data processing may be requested for the time necessary to check the accuracy of the data; ii) we are no longer authorised to process the data and instead of erasing the data, you can ask us to limit its use; iii) if the personal data in our possession, despite no longer being required for the purposes for which they were gathered, are needed by the Data Subject for investigation, to exercise or defend a right during a legal dispute;

    • Right to data portability, namely the right to receive all personal data concerning the Data Subject in a structured, commonly used and machine-readable format, as well as the right to request for the data to be transferred to another Data Controller;

    • Right to withdraw the consent to data processing that are based on said right;

    • Right to object to data processing at any time based on our legitimate interest.

    Moreover, the Data Subject has the right to lodge a complaint with the Data Protection Authority whenever the processing takes place in breach of the provisions of the GDPR.
